These general terms and conditions govern the rental of self-drive vehicles offered by BX Cars SARL AU.
Article 1 — Purpose
Short-term or long-term rental agreement for a self-drive vehicle between BX Cars (the lessor) and the customer (the lessee).
Article 2 — Lessee requirements
- Minimum age: 24 years completed
- Valid driving licence held in good standing for at least 2 years
- Valid identity document (CIN for Moroccan nationals, passport for foreigners)
- Mandatory physical presentation of the original licence when the vehicle is collected, even if a copy was sent in advance (email, WhatsApp or any other channel). No rental can be finalised without this physical verification.
Article 3 — Booking
Booking is made online or at the agency. Any booking becomes firm and final after written confirmation (email) from BX Cars. Any change must be requested beforehand.
Article 4 — Rates and payment
- Daily rate for short term (≤ 15 days) and long term (> 15 days)
- Accepted means of payment: cash or bank transfer. No payment by bank card or online for the time being.
- Deposit: in cash only, from 5 000 to 7 000 DH depending on the vehicle, handed over against a signed receipt and returned in full when the vehicle is returned in good condition and without overrun.
Article 5 — Collection and return
- Locations: Tanger agency (Rue 1 Beauséjour Lotis 15), Ibn Battouta airport (on request), hotel in Tanger (on request)
- Fuel: full to full — the vehicle is handed over with a full tank and returned with a full tank. Any shortfall is charged at the station rate + 50 DH service fee.
- Mileage: 250 km/day included. Beyond that: 3 DH/km extra, calculated upon return.
- Mandatory joint condition report at collection AND on return, signed by both parties.
Article 6 — Insurance
The vehicle is covered by a fleet insurance policy taken out with Sanlam Maroc (policy no.: [to be confirmed]). Coverage included: Third-Party Liability (mandatory), vehicle damage (CDW) and theft (TP).
The lessee's excess, in the event of a claim for which they are responsible, is equal to the amount of the deposit (5 000 to 7 000 DH depending on the vehicle).
Exclusions from cover: driving under the influence (alcohol, narcotics), undeclared additional driver, leaving Moroccan territory without written authorisation, off-road use, racing or non-compliant use. In the event of a claim above the limit or outside cover, the lessee remains liable for all costs.
Article 7 — Lessee's liability
The lessee drives carefully and complies with the Moroccan highway code. The following are prohibited: sub-letting, any undeclared additional driver, and leaving Moroccan territory without written authorisation. Costs of damage, theft or loss are borne by the lessee under the insurance conditions.
Article 8 — Breakdowns and claims
In the event of an accident: declaration within 24 h, an accident report form, and immediate contact with BX Cars. Breakdown assistance and replacement vehicle subject to availability.
Article 9 — Cancellation and refund
- More than 7 days before vehicle collection: 100 % refund
- Between 48 hours and 7 days before: 50 % refund
- Less than 48 hours before: no refund
- Booking change (dates, vehicle): allowed free of charge, subject to availability
Article 10 — Right of withdrawal
For EU consumer customers: a 14-day period (Directive 2011/83/EU). Exception: if the rental begins within 14 days, the right of withdrawal does not apply (service on a specified date, art. L221-28).
Article 11 — Vehicle tracking and remote immobilisation
Every vehicle in the fleet is fitted with a tracking unit, installed and operated by a specialist technical provider. The lessee is informed of this before collecting the vehicle and accepts it by signing the rental agreement.
11.1 — Data recorded
While powered, the unit automatically transmits: position, speed, direction of travel, mileage, ignition status, movement, battery voltage and signal quality. Readings are periodic (roughly every 30 seconds). The device records neither sound nor images and allows no listening inside the vehicle.
11.2 — Purposes
- protection of the vehicle: theft, attempted theft, failure to return;
- assistance and breakdown recovery: locating the vehicle after a breakdown or accident;
- verification of the mileage charged (article 5) and of compliance with the authorised area — leaving Moroccan territory without written agreement is prohibited (article 7);
- recording of speed limit overruns and handling of insurance claims;
- technical fleet monitoring: battery, servicing, abnormal immobilisation.
This data is subject to no commercial exploitation, no targeted advertising and no resale.
11.3 — Limits of the system
- tracking concerns the lessee only from handover of the vehicle to its return: there is no tracking before or after the rental;
- the system tracks a vehicle, not a person: the data is consulted only for the purposes listed above, by authorised BX Cars staff;
- no disclosure to third parties, other than the insurer in the event of a claim and the judicial or police authorities upon a duly issued request.
11.4 — Speed limit overruns
Any overrun of the threshold set by BX Cars (110 km/h at present, with a technical margin of 5 km/h) is recorded together with its date, location and the speed measured, and linked to the current rental agreement. A serious or repeated overrun may lead to the customer file being placed under review, termination of the agreement and refusal of any future rental. These readings are internal: they do not replace findings by the authorities and do not exempt the lessee from any fine.
11.5 — Remote immobilisation
Vehicles are fitted with a device capable of preventing the engine from being restarted. BX Cars may use it only in the following cases, which are exhaustive:
- reported theft or attempted theft;
- failure to return the vehicle at the end of the rental, after a formal notice has gone unanswered;
- unauthorised departure from Moroccan territory, or manifestly fraudulent use;
- serious and immediate danger to people or to the vehicle.
Immobilisation is never commanded on a vehicle in motion: it prevents a fresh start, it does not interrupt a journey under way. Except in cases of theft, the lessee is contacted beforehand. The decision rests with a BX Cars manager and is placed on record. The cost of restoring service is borne by the lessee where the immobilisation is attributable to them.
11.6 — Retention periods
- real-time position: displayed, not retained by BX Cars;
- journey history: retained by the technical provider for the period set out in its service agreement ([to be confirmed]), and consulted by BX Cars solely for the purposes of article 11.2;
- overrun records (date, location, speed): 12 months;
- incidents recorded in the customer file (reason, date, severity): 3 years after the last agreement;
- recorded mileage, a billing item: retained with the agreement, 5 years (accounting obligation).
11.7 — Additional driver
The lessee undertakes to inform any declared additional driver of the existence of the system and of the content of this article.
11.8 — Lessee's rights and integrity of the unit
The lessee has rights of access, rectification and erasure within the limits of the law, exercised in accordance with our privacy policy. As the system is necessary for performance of the agreement and protection of the vehicle, its operation cannot be suspended during the rental. Any deactivation, obstruction, disconnection or damage to the unit constitutes a serious breach: immediate termination of the agreement, retention of the deposit towards the cost of repair, and pursuit of damages.
A complaint may be lodged with the CNDP (Morocco) or the APD (Belgium).

Article 13 — Force majeure
Neither party is liable for a failure due to a case of force majeure within the meaning of Moroccan law.
Article 14 — Applicable law and jurisdiction
Moroccan law. Jurisdiction of the Commercial Court of Tanger. For EU customers, European mediation is possible before any legal action.
